CALGreen Construction Waste Management Requirements
Waste Diversion Requirements
- Newly constructed buildings and demolition projects shall divert from landfills at least 65% of the construction and demolition (C&D) materials generated at the project site.
- All locally permitted additions and alterations to non-residential projects shall also meet the minimum 65% waste diversion requirement.
- Additions and alterations to residential buildings that increase the structure's conditioned area, volume or size are also required to meet the 65% waste diversion requirement.
Methods of Compliance
- Applicants/Contractors are required to develop and maintain a construction waste management plan and document diversion and disposal. OR
- Utilize a waste management company that can provide verifiable documentation that it meets 65% waste diversion. OR
- Use a waste stream reduction alternative:
- Non-residential new construction and residential high rise (4 stories or more) projects with a total disposal weight of ≤ 2 lbs/ft2 meets the 65% waste diversion requirement.
- Residential low rise (3 stories or less) with new construction disposal of ≤ 3.4 lbs/ft2 meets the 65% waste diversion requirement.
Recycling by Occupants (Space for Recycling)
- Newly constructed non-residential buildings, certain non-residential additions and multi-family housing with ≥ 5 units should provide readily accessible areas that serve the entire building and are identified for the depositing, storage and collection of non-hazardous materials for recycling, including (at minimum) paper, corrugated cardboard, glass, plastics, organic waste and metals.
Universal Waste
- Universal waste (such as batteries, e-waste, lamps, cathode ray tubes/glass, aerosol cans) from non-residential addition and alteration projects shall require verification that the materials are disposed of properly and diverted from landfills. A list of prohibited universal waste materials shall be included in the construction documents. This is required for nonresidential additions of 1,000 ft2 or greater and building alterations with a permit valuation of $200,000 or above.
Recycled Content (Voluntary for Non-Residential Structures)
- Use recycled content materials that meets specified Recycled Content Value. Or simply use two or three materials out of 9 product types on the list: exterior paint, carpet, compost, mulch, acoustical ceiling panels, drywall, aggregate base, fiberglass or cellulose insulation.
Step-By-Step Process for CALGreen Waste Diversion Requirements
Step 1. Submit a Letter of Attestation at the time of application to understand waste diversion requirements.
Step 2. Prior to the issuance of a Building Permit, you are required to submit the Construction Waste Management Plan (CWMP or CW-1) and send to sw_admin@ci.lompoc.ca.us.
Step 3. When disposing of construction materials, materials will need to be sorted on-site (source-separated) or brought to a recycling facility that has a diversion rate of at least 65% for mixed C&D waste. Receipts/tickets from waste facilities need to be kept for recordkeeping and reporting requirements.
Step 4. After construction activities have ended, submit the Construction Waste Management Worksheet (CW-2) with supporting documentation (facility tickets/receipts) to sw_admin@ci.lompoc.ca.us and follow these instructions.

Direct Service Provider (DSP) Requirements
Under Senate Bill 1383, jurisdictions are required to meet an annual procurement target through the purchase or acquisition of recovered organic waste products (ROWPs) (compost, mulch, renewable energy in the form of fuel, heat, electricity). If your project was identified as a potential project that would use ROWPs, typically compost or mulch, then please see below for requirements needed for project approval.
All submittals (Part A and B of the Direct Service Provider Agreement, Direct Service Provider Reporting Excel, and Records (invoices or receipts of purchase) will need to be sent to sw_admin@ci.lompoc.ca.us. Step-By-Step Process for DSP Requirements
Step 1. Submit a Letter of Attestation at the time of application to understand waste diversion requirements.
Step 2. Prior to the issuance of a Building Permit, you are required to submit Part A of the Direct Service Provider Agreement to sw_admin@ci.lompoc.ca.us. Please mark in this form what materials you plan to use for your project (compost or mulch) and make sure the materials you purchase comply with the acceptable materials list located within the document.
Step 3. Purchase ROWPs, as applicable, for your project and keep the receipts! Receipts are needed for reporting requirements and approval for the Certificate of Occupancy.
Step 4. At the end of each calendar year, submit the Direct Service Provider Reporting Excel to sw_admin@ci.lompoc.ca.us.
Step 5. Prior to the issuance of a Certificate of Occupancy, you are required to submit Part B of the Direct Service Provider Agreement to sw_admin@ci.lompoc.ca.us. Additionally, submit any remaining records of purchases for ROWPs that you have not already submitted by using the Direct Service Provider Reporting Excel and sending it to sw_admin@ci.lompoc.ca.us.
